Privacy Policy (Belbroughton Cricket Club)

This document is notification of BCC’s policy in dealing with personal data (“PD”) relating to you and or any child who you as parent or guardian has registered as a member of BCC.

 Our website www.belbroughton.play-cricket.com (the Play-Cricket Website) is operated by the England and Wales Cricket Board Limited (the ECB). The website in respect of the BCC Fantasy Cricket League is operated by Fantasy Cricket League Limited (FCCL). Our website www.belbroughtoncc.co.uk (the BCC Website) is operated by Miribase Limited trading as Your Cricket Site.

Unless stated otherwise, the ECB is the data controller in respect of all personal data collected on the Play-Cricket Website which means that the ECB is responsible for ensuring that it does so in full compliance with data protection and all other related privacy laws.

Unless stated otherwise, Miribase Limited trading as Your Cricket Site (YourCricket.Site) is the data controller in respect of all personal data collected on the BCC Website which means that

Payments

We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g., payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. Please note, that the Play-Cricket Website and the BCC Website may contain links to other websites that are not controlled by us, the ECB or YourCricket.Site. We are only responsible for our own privacy practices. We recommend that you check the privacy and security policies and procedures of the Play-Cricket Website, the BCC Website and each and every other website that you visit, including, the website of FCCL.
 
2.THE INFORMATION WE COLLECT AND ITS SOURCES
 BCC’S officers and other representatives such as team Captains or managers collect and use the following PD:

-name, address, contact telephone number, date of birth(“DOB”), gender and email address

-in the case of a person under the age of 18 who is a member or whose parent or guardian wants such person to become a member, name, T-shirt size, DOB, school year, gender, name and address of parent(s)/carer(s) and landline, mobile phone and email details of one or both parents/carers 

- other information that is relevant to the member’s/parent’s / guardian’s / child’s needs such as any medical conditions, specific requirements information, disability information, allergy information or treatment that may need to be given to help the member, parent, guardian or child at a training session or in a match.
 

The information will be obtained from membership application or consent forms, the Play Cricket Website, the BCC Website and officers, coaches and managers, telephone conversations, emails and written and verbal communications.
 
We may supplement the information that you provide with other information that we obtain from our dealings with you or which we receive from other organisations.

By submitting your PD or PD relating to any child of yours you accept the terms of this Privacy Notice (as updated from time to time) and consent to BCC and any officer, team captain, team manager or other representative of BCC using such PD in accordance with this Privacy Notice (as updated from time to time).

PLEASE REMEMBER

The transmission of any PD via the internet is not completely secure. Although we will take reasonable precautions to protect your PD and or any PD relating to your child/children, we cannot guarantee the security of the transmission of such PD via the internet. Any such transmission is at your own risk.
 
Information about other people
 If you provide information to us about any person other than yourself, you must ensure that they understand how their information will be used and that you are authorised to disclose it to us, and to consent to its use on their behalf, before doing so.
 
3.HOW WE WILL USE YOUR INFORMATION
 All PD that we obtain about you and/or any other person (including any person under 18) whose details you provide will be recorded, used, and protected by us in accordance with current data protection legislation and this Privacy Policy. We will primarily use the PD:

-to fulfil any obligation to or to comply with the rules and regulations of Worcestershire Cricket Board Ltd(WCBL) and or the Worcestershire County League(WCL) and any other relevant cricket organisation including to register a player on the Play-Cricket Website and/or the BCC Website.

-to comply with a legal obligation to which we are subject

-to fulfil any obligation to any officer, member or any other person associated with BCC in accordance with the BCC Constitution

 - for membership and VP/social membership registration and general administration

 -to provide facilities and opportunities to participate in and to support the delivery of cricket coaching and training sessions and cricket matches

 -to maintain Worcestershire ClubMark Accreditation

 -to promote and invite participation in social or fundraising events, competitions or initiatives related to BCC

 - to communicate with you to inform you about activities at BCC including team fixtures and team selection

 -to identify the names of the players, including players who are under 18, selected to play for any BCC team in any written media, via email or text including What’s App or on the Play-Cricket Website, the BCC Website, its Twitter page or any other form of social media including, any “closed group” BCC Facebook Group

 -for record keeping purposes

 - to ensure appropriate certificates are prepared at the end of certain training sessions

 -to prepare print based and online materials relating to BCC such as the fixture card and the Junior &Youth Section Brochure

 - to carry out surveys so that we can improve the facilities of and opportunities at BCC

 -of players who played senior cricket in the preceding season to invite any member to and to enable any member to register an account on the FCCL website and create and manage a team in the BCC Fantasy Cricket Team (subject to the t’s and c’s and privacy policy of FCCL) and permit any member who has registered such an account to input the names of such players on the FCCL website


4. CONSENT AND LAWFUL PROCESSING OF PERSONAL DATA
 The legal basis for the collection and processing of your personal data is:
 
 • as necessary to comply with the relevant rule, regulation, responsibility or obligation referred to in Section 3 including for compliance with a legal obligation, to administer bookings and attendance at sessions and to support the delivery of cricket sessions and matches.

 • based on your explicit consent for dealing with medical needs/specific requirements.

 • based on your consent (or the consent of a parent or guardian in the case of the PD of any person under 18) for social or fundraising purposes, to communicate with you, for team selection purposes, to prepare print based or on-line materials relating to BCC , to carry out surveys, in respect of the BCC Fantasy Cricket League or where you request BCC or any BCC officer, manager or other representative to disclose your PD or PD relating to your child to other people or an organisation such as the WCBL or WCL.
 
• in all other cases: that it is necessary for our legitimate interests which are to build a programme to encourage participation in cricket at BCC and this does not prejudice or harm rights and freedoms of any person that joins, including any parent / guardian of or any child that joins, BCC.

5.PHOTO CONSENT

BCC follows the guidance issued in “Safe Hands-Welfare of Young People in Cricket” in respect of the use of images of Young People which is available at www.ecb.co.uk/safehands and will take appropriate steps to ensure that such images are used solely for the purposes for which they are intended which is the promotion and celebration of cricketing activities.

BCC will therefore only use images and videos of children for whom we have a signed consent from a parent. For the purposes of this document any references to “Parent” or “parent” incorporate all classifications of legal guardian or carer.

If photographs or video footage are taken of players or a team or action shots and are used in the BCC Newsletter or any newspaper report or any other form of print media or are posted on the Play-Cricket Website, the BCC Website, its Twitter page or any other form of social media, individuals will not ordinarily be identified.

Where a child or young person is identified, it will only be with the explicit consent of a parent. Whilst BCC will do what it can to ensure the safety of children captured by either video or still image, it is the responsibility of the parent concerned to ensure that if their child is not to be photographed or filmed and takes part in an activity which results in that child being inadvertently photographed or filmed, neither BCC nor its officers, coaches, managers, members, representatives, servants or agents will be liable or held responsible.


6.DISCLOSING YOUR PERSONAL INFORMATION
 In order carry out some of the activities in Section 3 we may:

6.1 occasionally, appoint other organisations to carry out some of the processing activities on our behalf. These may include, for example, technology hosts, printing companies and mailing houses. In these circumstances, we will ensure that personal information is properly protected and that it is only used in accordance with this Privacy Policy or as the case may be the privacy policy of the ECB in the case of PD on the Play-Cricket Website, the privacy policy of YourCricket.Site in the case of PD on the BCC Website or the privacy policy of FCCL in the case of the BCC Cricket Fantasy League;

6.2 disclose PD to Leagues, the ECB, BCC officers, coaches and managers, volunteers who work at BCC to support the delivery of sessions/matches and the County Cricket Board that supports  the programmes and competitions for which BCC has registered.
 

7.INFORMATION ABOUT BCC
 We would like to contact you and/or any person whose information you provide to us to provide information about activities at BCC, such as, social or fundraising offers and opportunities that are available  including by text message or by email.   Details of how to opt-in to or opt-out of receiving such information appear below or are in relevant forms you complete and/or in the electronic message you receive.  
 
Preferences / Subscribe / Unsubscribe
 
You and any other person whose information you have provided to us can change your/their mind about whether you wish to receive information about BCC at any time by using any of the methods shown below (see the section ‘How to contact us’ below) or by following the instructions with each form or message you receive 
 
8.DATA RETENTION
 We will normally keep PD for two years or for so long as there is a need to keep it in connection with any of the purposes for which it was collected in accordance with Section 3 . If, after this point, you are not an officer, representative, member, VP or social member of BCC or in the case of PD relating to  a person under 18 who is no longer a junior or youth member, we will keep only minimal personal data to comply with our obligations or legal requirements.
 
9.USE OF YOUR INFORMATION OUTSIDE OF EUROPE
 We do not currently transfer personal data outside of the United Kingdom or the European Economic Area.  If this changes and we do need to transfer your personal data to other territories, we will take proper steps to ensure that it is protected in accordance with applicable privacy laws.
  
10.CHANGES TO THIS PRIVACY POLICY
 Privacy laws and practice are constantly developing.  Our policies and procedures are, therefore, under continual review. We may, from time to time, update our security and privacy policies.  If we want to make any significant changes in how we will use your personal data we will contact you directly and, if required, seek your consent.
 
We will ensure that the Play-Cricket Website or the BCC Website has BCC’s most up to date policy and suggest that you check this page periodically to review our latest version.
 
 
11.UPDATING AND CORRECTING INFORMATION
 You may update or correct your personal information or personal information relating to your child when you are asked to complete a Membership Application Form or other similar document in respect of you and or any child of yours or by contacting us in writing or by email (see the section ‘How to contact us’ below). Please include your name, address and/or email address when you contact us as this helps us to ensure that we accept amendments only from the correct person. We encourage you to promptly update your personal information if it changes.  
 
If you are providing updates or corrections about another person, we may require you to provide us with proof that you are authorised to provide that information to us.
 
12.YOUR RIGHTS
 You have a number of legal rights in respect of your personal data.  These include:
 
▪ access.  The right to receive a copy of the personal data that we hold about you.  The same right applies to any other person whose personal data you provide to us.  We will require proof of identity and proof of authority if the request comes from someone other than the person whose data we are asked to provide.  This will ensure we only provide information to the correct person.  We normally expect to respond to requests within 28 days of receiving them.

• the right to be informed about our processing of PD relation to you or your child.

 ▪ withdraw consent to direct communication.  You can exercise this right at any time and can update your preferences yourself or ask us to do it for you.  See section 11 above for details.

 ▪ withdraw consent to other processing.  Where the only legal basis for our processing your personal data is that we have your consent to do so, you may withdraw your consent to that processing at any time and we will have to stop processing your personal data.  Please note, this will only affect a new activity and does not mean that processing carried out before you withdrew your consent is unlawful.

• the right to object to processing of PD relating to you or your child.

 ▪ correction.  If you consider any of your personal data is inaccurate, you can correct it yourself or ask us to do it for you (see section ‘Updating and correcting your personal data’ above for details).

 ▪ restriction.  In limited circumstances you may be able to require us to restrict our processing of your personal data.  For example, if you consider what we hold is inaccurate and we disagree, the processing may be restricted until the accuracy has been verified.

•PD erased. The right to have your PD or PD relating to your child erased (the “right to be forgotten”)

If you exercise your right to withdraw consent it will not affect the lawfulness of any processing for which we had consent prior to your withdrawing it.
